IN THIS GUIDE · Order the steps so nothing irreversible happens early
Start with the TN eligibility and application overview
Week one: the free work that takes the longest
Order a certified transcript and degree confirmation from the registrar, locate a citizenship certificate or passport, and, if professional registration is relevant, request a letter of standing from the body that holds it. Where a degree was earned outside Canada, Mexico or the United States, arrange a reliable credential evaluation. Issuer lead times vary and are outside the applicant's control once a request is made, so obtain current estimates before promising a start date. Make a document index beside the requests: issuer, date requested, expected wording, and the fact the record proves. A transcript proves the award; it does not prove the proposed duties. Keeping those functions separate makes a later review quicker and avoids trying to make one record answer every question.
Week two: the questions that could end the plan
Read the published schedule entry for the profession being claimed and compare it against a written description of the actual duties, not the job title. Confirm citizenship of Canada or Mexico, since permanent residence does not satisfy this requirement however long it has lasted. Establish who the legal employer is and whether the work will be performed at a client's site under someone else's direction. Any of these can end the plan, and they cost nothing to check, so they belong before any spending or any resignation. The decision here is whether the factual role can be described honestly within one schedule entry. If the answer depends on retitling ordinary duties or leaving out a substantial part of the work, pause. A different route or a changed assignment may be the practical result, and finding that out early preserves choices.
Week three: fix the structure while it is still changeable
This route covers prearranged professional work for an employer and does not authorise self-employment in the United States, so any ownership interest in the entity receiving the services must be disclosed and examined while the arrangement can still be altered. If the plan involves the engineer invoicing through their own company, that may be inconsistent with TN employment and should be examined before a port-of-entry request or filing. A state practice licence is a separate question from the qualification rule attached to the listed USMCA profession. Ask for the proposed reporting line, payment source, and right to direct the work in writing. Those records show whether the arrangement is genuine employment rather than an attempt to relabel independent commercial activity. They also identify whether a client-site arrangement needs a fuller explanation.
Last: the steps that cannot be taken back
Only when the records have arrived and the structural questions are answered should the irreversible steps happen: agreeing a firm start date, giving notice, ending a lease, moving a family. Canadian citizens generally do not need a TN visa stamp; they may request TN classification at a port of entry with supporting evidence, or a U.S. employer may file Form I-129 with USCIS. Confirm which route the employer intends before anything is arranged around it, and confirm what happens to the position if the first attempt does not succeed. Before acting, assemble a final review packet in the order a stranger would ask questions: identity, credential, profession, duties, employer, and travel plan. That sequencing shows gaps immediately. A request made during inspection is not a substitute for a file that has been tested against the governing conditions.
