IN THIS GUIDE · Gather the evidence before the shop floor changes
Start with the L-1B eligibility and application overview
Collect the contemporaneous record while it exists
Procedure qualification records, weld maps, revision histories naming the author, internal training material, and job files showing where a procedure was developed and first applied are the substance of this classification. They were created for operational reasons, which is exactly why they persuade. Pull them before a server is migrated, a filing system is replaced or a supervisor retires. A description written later, however accurate, cannot substitute for a record that shows the work happening at the time, and the gap between those two is what a careful reader notices. Preserve originals and capture where they came from. A revision log, repository history, or contemporaneous training record carries more weight when its date and custodian are clear. The review should identify which record proves authorship, which proves restricted use, and which proves the related entity’s need.
Establish that the knowledge belongs to the company
The classification reaches special knowledge of the organisation's product, service, research, equipment, techniques, management or other interests, or advanced knowledge of its processes or procedures. The knowledge need not be proprietary or unique, but general welding skill or a certification widely held in the trade is not enough by itself. A procedure the shop developed, qualified and refined for its own products may be strong evidence when the employee's knowledge of it is special or advanced. Set out what is standard practice in the industry and what the employee knows about this organisation's operations, and let the documents establish the distinction rather than adjectives. The decision is not whether the employee is talented. It is whether the knowledge is unusually connected to this business and its methods. A comparison table can identify what an experienced outside hire could know from public standards and what would require this company’s accumulated internal work.
Confirm the same structural conditions, in the same order
Nothing about this classification relaxes the threshold requirements, and they should be checked before any technical work begins. Counsel confirms the qualifying relationship between the organisations from ownership documents. Payroll confirms twelve unbroken months of qualifying employment abroad within the closing three-year window. Both organisations must be actively doing business. An excellent technical record attached to a broken employment period cannot be filed, and checking these first takes days rather than weeks. Order the work so that a fatal answer arrives before the expensive effort, not after it. Check the ownership relationship and work-history table before investing in technical explanation. If either threshold record fails, extra detail about the procedure will not cure it. This order also prevents disclosure of sensitive internal material unless the structural case is viable.
Plan the end of the placement at the beginning
This classification carries a five-year maximum, shorter than the managerial one, and the household and the business should both plan against that from the outset. Decide early whether the intention is a defined transfer of capability followed by a return, or a longer presence that would need a different route built on facts developed in the meantime. If the specialist will work inside a customer's operation, establish who directs the work, because an arrangement amounting to labour supplied for hire to another business does not fit. L-2 spouses are employment-authorised incident to status. Set milestones for training, documentation, and handover at the receiving operation. They explain why the person is needed and let the business measure whether the mission is progressing. A plan with a defined endpoint is easier to reconcile with a category that does not provide an unlimited period of stay.
