Read the general immigrant investor briefing overview
Hypothetical example: an equipment-leasing owner wants permanent residence and is weighing the immigrant investor route against the Gold Card framework. Both involve large sums and both are hard to reverse, so the comparison itself has an order. Do the free verification first, then the cheap professional review, and only then consider which commitment to make. Neither should be entered while a material question is still open. Hypothetical example: a medical-device packaging owner has liquidity after selling a company and must decide whether to accept investment risk tied to job creation or make an unrecoverable government gift under current official terms. The first decision is not which sounds quicker; it is whether the money’s destination, continuing conditions, and available legal path fit the household’s objective. Record the official source and verification date for every comparison point.
First, establish what happens to the money
Under EB-5, the current qualifying capital is US$1,050,000, or US$800,000 for a targeted-employment-area or infrastructure investment. The capital enters a commercial enterprise and remains at risk, and the route also requires lawful source and path of funds, at least ten full-time jobs for qualifying U.S. workers, and engagement in management or policy formulation. Under the current individual Gold Card framework, a nonrefundable US$15,000 processing fee and vetting precede a US$1 million gift made after successful vetting and official instructions. EB-5 capital may return value or be lost; the Gold Card gift is given and is not an EB-5 investment. Make the money flow visible on one page: investment enterprise and commercial risk on one side, government gift on the other. That comparison prevents a nonrecoverable payment from being mistaken for deployable capital.
Second, establish what continues after approval
EB-5 grants conditional permanent residence for two years and requires Form I-829, filed in the 90 days before the second anniversary, to establish the sustained investment and required job creation under the applicable rules. The current Gold Card framework instead proceeds through Form I-140G using EB-1A or EB-2 national-interest-waiver classifications, with the gift receiving the prescribed evidentiary treatment; admissibility and visa availability still apply. The official page describes expedited processing that should take weeks, but no individual completion date is guaranteed. Record the date each official term was checked and re-verify it before any payment. List the post-approval evidence each path requires and who will keep it. The decision should account for ongoing reporting or proof, not only the initial transfer.
Third, list what remains unanswered and weigh it
List the household's material questions: timing, treatment of children, consequences of failure and whether any money can return. EB-5 derivatives are the principal's spouse and unmarried children under twenty-one, subject to any applicable statutory age protection, and they share the principal investment. Under current Gold Card terms, each eligible joining spouse or unmarried child under twenty-one adds a separate nonrefundable US$15,000 processing fee and, after successful vetting and instructions, a US$1 million gift. Visa Bulletin cut-off dates may affect timing for either immigrant framework. Answer from official sources, mark genuinely unresolved questions, and re-verify all terms before committing funds. Mark any unanswered official question as a risk, with a date to recheck it. A household can then decide whether uncertainty is tolerable or whether it should wait for clearer procedures.
