Start with the L-1A eligibility and application overview
First dependency: what the ownership documents say
The two organisations must stand in a qualifying relationship, as parent and subsidiary, as branch, or as affiliates under common ownership and control. This is proved from share registers, articles or partnership agreements, not from an organisation chart. Drilling contractors often operate through several companies for equipment, labour and contracting reasons, and the entity that employs a manager may not be the one connected to the venture abroad. Read the documents before anything else is prepared, because if the structure does not qualify, the remedy is corporate work measured in months. Create a simple ownership diagram only after matching it to the underlying records. Label each share percentage, voting right, and effective date. The diagram then becomes a review aid rather than unsupported advocacy, and it makes a missing transfer document visible while there is still time to obtain it.
Second dependency: the twelve months on payroll
The employee needs one continuous year of qualifying employment abroad with a qualifying organisation within the applicable three-year period before the petition. Check payroll and travel records rather than relying on memory. A seasonal interruption or a period worked as an independent contractor may interrupt qualifying employment, but a payroll move within the qualifying group does not automatically do so. Time physically spent in the United States does not build the foreign-employment year, although a brief U.S. trip does not itself break continuity. Where no qualifying year exists, the company may need to wait while the employee completes one, which is why the issue must be found before a season is planned around the posting. Test continuity against dated payroll, tax, leave, and assignment records in a single table. The table should identify the employer of record and the country for every period. It gives the reviewer a way to resolve a gap instead of relying on a manager’s recollection of a long project.
Third dependency: whether the role is genuinely managerial
Only once the structure and the employment period hold does the character of the role matter. The managerial or executive classification asks what the person does in an ordinary week: who reports to them, which decisions they take without approval, what function or budget they control, and how much of the time is spent doing operational work personally. A district manager who runs crews from a truck and also operates equipment is doing essential work that may not fit. Where the honest description is technical, the specialized-knowledge classification may fit the facts better and should be considered rather than forced. Write a week-in-the-role calendar that separates supervision, budget decisions, policy work, and hands-on production. That exercise often settles whether the position is ready to present as managerial. It may also show that a staffing change must occur before filing, rather than being merely hoped for after arrival.
Last: the commitments that assume approval
Base leases, equipment moves, crew reassignments and the manager's own relocation all assume an outcome that has not happened yet, so they belong at the end of the sequence. A new operation abroad is normally approved initially for one year with evidence of secured premises and the capacity to support the role, and the managerial classification carries a seven-year outer limit. Where the manager will spend time at exploration clients' sites, establish who directs that work, since an arrangement functioning as labour supplied for hire to another business falls outside the classification. Decide who will own each operational dependency if approval is delayed: premises, client commitments, equipment, and the transferee’s current role. A contingency plan is evidence of a real business decision, not pessimism. It avoids presenting a first-year plan that works only if every outside event arrives on time.
