FOR IMMIGRANT INVESTORS · NEEBINGNeebing

Invest in anew chapter.

Hypothetical example: a family that has run a customs brokerage for two generations is considering placing capital into a distribution warehouse development abroad in order to obtain permanent residence. Of all the tasks ahead, one is reliably the longest and is entirely within the family's control to start: documenting where every dollar came from. Project selection, legal work and family planning all matter, but none of them takes as long as reconstructing a financial history, and none of them can substitute for it. A useful first review follows each dollar from its lawful origin through every account to the new commercial enterprise, then separately tests the project’s job plan and the investor’s immigration timing. It should identify gaps that a bank record, sale contract, tax filing, or gift record can resolve. EB-5 capital must remain exposed to loss under the applicable rules, the investment must support the required job creation, and admission begins with conditional permanent residence. Those continuing elements mean that selecting a project is only the first decision, not the end of the process.

Start with the EB-5 eligibility and application overview

01

Day one: reconstruct the financial history

The capital has to be lawfully obtained and traceable in an unbroken line from its origin to the enterprise. For a family whose wealth grew from a brokerage business, that means corporate financial statements, personal and corporate tax filings across many years, records for any property or shareholding sold, and statements for every account the money moved through. Where any part is a gift or a loan, the person providing it has to document their own source as well. Request the oldest records first; institutions are slowest with those and some require formal applications. Prepare a source-and-path diagram with dates, account names, and the record available for each movement. The decision is whether an independent reader can follow the trail without inference. Where the money passed through a company or relative, obtain the documents for that intermediate step rather than explaining it later from memory.

02

In parallel: test the project's job arithmetic

The route requires ten or more full-time jobs held by workers who qualify, and this is where a development's optimism should be examined before capital is committed. Identify which specific roles are counted, whether they arise from construction or from operations, over what period they are filled and how they are sustained. Ask what the count becomes if the development is delayed or reduced in scale. The job evidence matters most at the later stage, when conditions on residence are lifted, so a methodology that does not withstand reading now will not improve with time. Read the project plan as an operating promise: identify the job methodology, the assumptions behind it, and who reports progress. This allows the investor to decide whether the business risk is understood rather than simply relying on a projected outcome. It also reveals whether a material change would need careful analysis later.

03

Before committing: confirm the amount and the designation

The statutory investment is one million and fifty thousand dollars, or eight hundred thousand where the investment falls within a targeted employment area or a qualifying infrastructure category under the 2022 reform legislation. Where the lower figure is claimed, obtain the designation evidence rather than the assertion, since it turns on the specific location under the rules as they currently stand. Both the figures and the criteria have been altered by legislation before, so verify them against the official program materials at the moment of decision rather than relying on an earlier understanding. Separate the petition timeline from visa availability and from the project’s construction or operating schedule. A favourable petition result does not itself place the investor in permanent residence. Mapping the three clocks helps the household decide whether it can tolerate delay without treating one event as proof that the others have occurred.

04

After approval: the obligations that continue

A successful applicant and qualifying family members receive conditional permanent residence lasting two years. The investor then files Form I-829 to remove conditions and must establish the sustained investment and required job creation under the applicable rules. The investor must be engaged in management or policy formulation rather than holding a wholly passive stake, and that role should appear in the governing documents from the outset. Derivatives are the spouse and unmarried children under twenty-one, subject to any applicable statutory age protection based on the individual filing and visa-availability facts. Keep a continuing file after admission: capital deployment records, job evidence, and explanations for any change from the business plan. The removal-of-conditions stage asks for a record built over time. Designing that record at the start is far safer than reconstructing it near the end of conditional residence.
