IN THIS GUIDE · A specialist whose working days would be spent inside somebody else's terminal
The knowledge has to belong to the employer, not to the industry
Specialized knowledge means special knowledge of the petitioning organization's product, service, research, equipment, techniques, management or other interests and their application in international markets, or an advanced level of knowledge of the organization's processes and procedures. A skilled controls engineer who could take the same abilities to any equipment manufacturer is describing general expertise, however scarce it is in the labour market. Devraj's better argument is narrower and more concrete: he authored the company's own control routines, he holds the change history in his head and in his commit records, and nobody outside the organization has worked with that logic. The petition should therefore be built on what is specific to this employer's system rather than on how difficult his field is generally.
Placement at a customer's site brings a second, independent test
Where a specialized-knowledge employee will be stationed primarily at the worksite of an employer other than the petitioner, the petition must show that the employee will not be controlled and supervised principally by that other employer, and that the placement is connected to the provision of a product or service involving specialized knowledge specific to the petitioner rather than to the supply of labour for hire. Both conditions have to hold. In practice that means the affiliate's service agreements, not just the immigration paperwork, need to show that the customer is buying a commissioning or upgrade service from the company, that Devraj reports to the company's own service manager, and that the customer cannot direct his hours or reassign him to unrelated work.
Five years is the ceiling, and it arrives faster than people plan for
L-1B status is limited to five years in total, and time spent in the classification counts whether the assignment was productive or not. For a specialist supporting a rollout across several terminals, that limit can be reached in the middle of a program. Two responses exist and both need planning well in advance. Time spent physically outside the United States can generally be recaptured where travel records prove it, which is a reason to keep a disciplined log from the first admission. A change to L-1A is possible where the role genuinely becomes managerial or executive, but it has to become that in substance, with a team or an essential function to manage, and the change must ordinarily be requested well before the fifth year closes.
