THUNDER BAY · HOUSEHOLD PERMISSIONS

Four people, four sets of permissions, and one birthday that ends part of it

THE SHORT ANSWER

Hypothetical example: the Ojanpera household is preparing to move for an intracompany transfer. The principal will hold specialized-knowledge status, the spouse intends to keep working, the elder child turns twenty-one in fourteen months, and the younger is twelve. Nobody in the family has a status of their own; all three depend on the principal's. What each of them may do differs, and the differences are not intuitive, so they are worth writing down before anyone resigns a job or accepts a school place.

01

The principal's category writes everybody else's rights

Derivative status is not a general permission to live in the United States; it is defined by the classification the principal holds and it ends when that classification does. Under the intracompany categories a spouse is employment-authorized incident to status and may work for any employer. Under the professional trade category the equivalent dependant status carries no work authorization at all. Under the treaty investor category a spouse is again employment-authorized. Because these differ so sharply, a household comparing two routes should compare the derivative rules alongside the principal's requirements, since for many families the spouse's ability to work is what makes one option viable and the other impossible.

02

The child fourteen months from twenty-one

A derivative child qualifies while unmarried and under twenty-one, and the birthday arrives whether or not anything else has been arranged. For the Ojanpera family that gives a little over a year to establish an independent basis for the elder child to remain: an accepted place in a course of study with its own status, an employment classification in the child's own right, or a return to Canada. None of those can be organized in a fortnight. Where the family is also pursuing permanent residence, the rules for calculating a child's age in that process are a separate analysis and depend on filing dates and visa availability, which is a reason to take advice on the sequence early rather than late.

03

Study is broadly permitted; work almost never is

Children in derivative status may attend school, and a dependent spouse may generally study as well, so education is the least troublesome part of most family moves. Employment is the opposite. Where the derivative category carries no work authorization, that restriction covers everything: a local job, freelance work, and continuing to work remotely for a Canadian employer from inside the United States. Families sometimes assume the last of these is outside the rules because the employer and the pay are Canadian, and that assumption creates real exposure. The safest approach is to establish, in writing and before departure, exactly what each member of the household is permitted to do, and to plan the family budget on that basis.
