IN THIS GUIDE · Separate proprietary knowledge from professional skill
Start with the L-1B eligibility and application overview
The distinction that decides the petition
General competence in an occupation is not specialized knowledge, however scarce that competence is locally. A skilled controls technician who could be hired by any mill is describing a labour market problem, not a legal qualification. What supports the petition is knowledge tied to something the organization itself created or developed: internal specifications, a proprietary configuration, a method documented only inside the company, or an equipment adaptation that does not exist elsewhere. Identify the artefact that knowledge attaches to, and the argument becomes concrete instead of adjectival.
Evidence that a reader outside the company can weigh
The useful records are the ones produced before anyone thought about a petition: internal design documents naming the employee, change logs, training material they authored, patent records or contemporaneous confidentiality and access-control records, project records showing what they built and when, and comparisons against what is commercially available. A letter written after the decision to transfer, describing the employee in superlatives, carries little weight on its own. Where documentation is thin because a small operation never wrote things down, say so and identify what does exist rather than inflating a summary.
The same threshold conditions still apply
L-1B does not relax the structural requirements. The qualifying relationship between the two organizations must be evidenced by ownership records, the employee must have one continuous year of qualifying employment abroad within the three preceding years, and both entities must be actively doing business. A strong specialized-knowledge story attached to a broken qualifying year is not a filing. Check the structural conditions first, exactly as for a managerial transfer, and treat the knowledge evidence as the part that distinguishes the classification rather than as the part that carries it alone.
Placement, duration and what happens next
L-1B status carries a five-year maximum, shorter than the managerial classification, and that limit should be part of the plan rather than a discovery in year four. If the employee will work at a client site, the arrangement must remain genuine employment controlled by the petitioner and must not be labour supplied for hire to another business; this is examined closely where a transferee sits inside a customer's operation. L-2 spouses are employment-authorized incident to status, which is a material fact for a household considering a five-year horizon.
Explain the actual special or advanced knowledge
For work primarily at an unaffiliated employer’s site, assess actual control and supervision and the restriction on arrangements essentially supplying labour for hire. Where the schedule includes visits to unrelated customers' facilities, say so and explain who assigns and supervises the work, since a specialized-knowledge employee cannot be placed with a third party principally to supply labour that the third party directs. Record U.S. days separately from qualifying foreign service without assuming brief visits automatically interrupt continuity. The actual special or advanced knowledge standard must be supported without imposing a universal uniqueness or secrecy requirement.
