Read the general life across the border overview
Hypothetical example: a farm couple is considering a U.S. work move while their twenty-year-old plans to begin a university programme there. Two clocks are running that have nothing to do with each other. Derivative status ends at twenty-one, and a study plan has its own requirements. Deciding early whether the young adult travels as a dependant or on their own basis avoids a change forced mid-programme.
Count the birthday against the calendar
A child included as a derivative stops fitting that classification at twenty-one, and for a family whose move is planned over a year or two that boundary can fall in the middle of a first academic year. Work out the exact date and place it beside the intended travel and enrolment dates. If the young adult would turn twenty-one shortly after arrival, planning the study route independently from the outset is usually simpler than arranging a change under time pressure. Where a permanent-residence process is involved, published statutory age protections may apply and their operation depends on filing dates rather than on the birthday alone.
Dependent status does not carry work permission
Whatever route the parents use, children in dependent status may generally study under the published guidance on which nonimmigrant classes may do so, and they hold no work permission through that status. A spouse's position is different and category-dependent: spouses in the treaty investor and intracompany transfer classifications are employment-authorized incident to status, while dependants of a professional worker in the reciprocal North American category are not. Write down each household member's permissions separately, because the assumption that a family shares one set of rights is the source of most planning errors here.
Each person's activity determines their route
The organising principle is that what a person will actually do determines their permissions, not simply their relationship to whoever is leading the move. A young adult who will study must confirm that the chosen status permits the planned course; one who will work needs work authorization; a spouse who intends to work needs either a status that carries authorization or an independent route. Treating the household as a single application with attached family members works only while everyone's plans are genuinely derivative. Setting out a short table of who does what, and under which permission, is the most useful hour a family can spend early on.
