IN THIS GUIDE · Trace the capital and count the jobs honestly
Start with the EB-5 eligibility and application overview
The capital amount and where it applies
The statutory investment is one million and fifty thousand dollars, reduced to eight hundred thousand dollars where the investment is in a targeted employment area or an infrastructure project, under the 2022 reform legislation. Because the qualifying amounts and the designation rules have been revised before, confirm the figures and the current area designations against the official program materials at the time the investment is actually contemplated rather than relying on a figure quoted elsewhere. Whether a particular rural location carries a targeted designation is a question of fact to be verified, not assumed from its rural character.
Source of funds is the longest piece of work
The capital must be lawfully obtained and the path from its origin to the enterprise must be documented continuously. For a family whose wealth came from decades of agricultural operations, that means tax filings, financial statements, land or equipment sale documents, and account records covering every step and every intermediate account. Where funds came by gift or loan, the giver's or lender's own source has to be documented as well. This work routinely takes longer than every other element combined and cannot be compressed at the end.
Ten jobs is a number that must be evidenced
The requirement is at least ten full-time positions for qualifying U.S. workers, and a cold-storage facility is capital-intensive, which means the job count deserves scrutiny before the money moves rather than afterwards. A credible plan identifies the positions, their hours, when they are filled and how they are sustained, and distinguishes construction activity from ongoing operations. The investor must also be engaged in management or policy formulation rather than holding a passive stake, and that engagement should be reflected in the governing documents from the beginning.
Conditional residence and what follows it
A successful investor and qualifying family members receive two-year conditional permanent residence, and the conditions are removed through Form I-829, which must show the investment was sustained and the jobs were created. That second stage, not the first, is where a weak job plan is exposed. Derivatives are the spouse and unmarried children under twenty-one, with the statutory age protections applied as published. Visa availability by country of chargeability affects timing and is published in the monthly bulletin, so the calendar is only partly within the family's control.
Direct investment means the record is yours to build
Direct investors count actual employees of the new commercial enterprise; the indirect and induced jobs produced by economic modelling are available in regional centre cases, which is a substantial part of why regional centres exist. For direct jobs, review eligible employees and the generally 35-hour weekly full-time standard; investors, their spouses or sons and daughters, nonimmigrants and independent contractors do not count as direct qualifying employees. The methods permitted to evidence job creation differ between a standalone investment and an investment through a regional center, so the applicable method shapes what a delay means for your record. Contractual investor repayment rights and guaranteed rates of return are excluded; the enterprise’s sole-discretion buyback exception requires petition withdrawal unless sustainment and the other requirements have been fulfilled.
