THE SHORT ANSWER

Hypothetical example: a pulp-mill process engineer can either move into an affiliated operation abroad or buy a mill-services company outright. Comparing the two in the abstract wastes time. Instead ask, for each route, what facts already exist and which condition is weakest. The route whose weakest condition is strongest is usually the right answer, and sometimes the honest answer is that neither works yet. Hypothetical example: a commercial laundromat chain operator can transfer a manager through an affiliate or acquire a U.S. location personally. The decision is which record is strongest today: ownership and a qualifying employment year for the transfer, or personal capital, business control, and a viable operating plan for the acquisition.

01

Ask which facts you already have

The transfer route rests on facts that either exist or do not: a documented ownership relationship between two organisations, one continuous qualifying year of employment abroad within the preceding three years, both entities actively doing business, and a role that is genuinely managerial or executive or that rests on knowledge specific to the company rather than the trade. The purchase route rests on different facts: treaty nationality of the investor and of the enterprise's ownership, capital irrevocably committed and at risk, a real operating enterprise that is not marginal, and the investor developing and directing it. Put the existing facts on two separate evidence lists rather than blending them. Payroll and corporate records answer transfer questions; purchase terms, ownership, and capital tracing answer the investor questions.

02

Ask what each route obliges you to keep doing

A transfer keeps the employer at the centre and the individual as its employee, with a seven-year ceiling for a managerial classification and five years for a specialized-knowledge one, and with continuation depending on the operation remaining genuine. A purchase places personal capital permanently at risk and ties status to the continued existence of that qualifying investment, with no direct route to permanent residence. Spouses are employment-authorised incident to status under both, which matters to a household weighing them. Ask which ongoing obligation the family is genuinely prepared to carry. Compare the obligations after approval, including the work role, temporary limits, business performance, and family plan. A route that fits at filing may become weak if its ongoing condition conflicts with the real plan.

03

Ask where each route is weakest, and compare those

Abstract comparison flatters both options. Instead identify the weakest condition in each and put those side by side. If the qualifying year is broken or the ownership between the entities is informal, the transfer route is weaker than it looks. If the available capital would leave an acquired business without working capital, or the intended structure gives the buyer less than operational control, the purchase route is weaker than it looks. This comparison usually produces a clear answer quickly, and occasionally produces the answer that more preparation is needed before either is viable. Choose the route with fewer unsupported assumptions, even if it is less attractive in the abstract. A simple documentary gap can be repaired; a missing legal relationship or unviable business premise needs a different decision.

A CONVERSATION IS A GOOD PLACE TO START.
